Background Checks - How To

The Virtual Chase posted an article that ran in Law Office Computing (Oct./Nov. 2004) about how to conduct a background check. The article is informative and offers links to fee-based sources online. It also cautions attorneys conducting such investigations on legal issues. "Several federal laws govern access to public records and personal information. The Gramm-Leach-Bliley Act (GLB) regulates the disclosure of personal information in records maintained by financial institutions. The Fair Credit Reporting Act (FCRA) governs access to consumer reports. The Drivers Privacy Protection Act (DPPA) regulates access to personal information in driving records. Additional federal laws contain privacy provisions that restrict access to public school and medical records, as well as other records maintained by government agencies."
